BOOKING TERMS AND CONDITIONS

01. General Conditions

1.1 These conditions govern the booking of tailor-made journeys and other tourist services organised by allumette,a trade name of Gastro Caddie S.L., tax ID B09710898, with registered address at Calle Quijorna 7, Villanueva de la Cañada (Madrid), Spain (hereinafter, «allumette»).

1.2 By confirming a booking, the traveller accepts these conditions and the specific conditions of the services booked, as set out in the travel proposal and in the confirmation invoice.

1.3 The person making the booking does so on behalf of all the travellers included in it and guarantees that all of them are aware of and accept these conditions.

02. Price

2.1 The price of the journey is the one stated in the proposal and in the confirmation invoice. It is expressed in euros and is the total for all travellers, without a breakdown by service, and includes only the services described in the proposal.

2.2 Unless the proposal states otherwise, the following are not included: flights, food and drinks at restaurants (allumette manages the reservations, but the bill is paid by the traveller), tips, personal expenses, insurance and any local tourist taxes that may be charged at the destination.

2.3 Once the booking is confirmed, the price may only be revised due to changes in the cost of transport or fuel, in the taxes and duties on the services booked or in the applicable exchange rates, and provided the traveller is notified at least 20 days before the start of the journey. If the increase exceeds 8% of the total price, the traveller may terminate the contract without penalty. If those costs decrease, the traveller will be entitled to the corresponding reduction.

2.4 Any change to the itinerary requested by the traveller may lead to a revision of the price, which will be communicated before it is applied.

03. Payments

3.1 A deposit of 25% of the total price is required to confirm the booking. If the payments that must be made in advance to suppliers exceed that amount, allumette may request an additional sum, which will be stated in the confirmation invoice.

3.2 The remaining balance must be paid no later than 40 days before the start of the journey. Bookings made less than 40 days in advance require full payment at the time of confirmation.

3.3 Payments are made in euros by bank transfer to the account stated in the confirmation invoice. Transfer fees are borne by the traveller. The booking is confirmed upon receipt of payment.

3.4 If full payment is not received within the stated period, or if additional services requested remain unpaid, the traveller will be deemed to have cancelled the journey and the cancellation policy will apply.

04. Cancellation by The Traveller

4.1 The traveller may cancel the booking at any time by giving written notice. Cancellation entails the following charges, calculated on the total price of the journey:

  • Up to 31 days before the start of the journey: 25% (the amount of the deposit).

  • Between 30 and 15 days before: 75%.

  • Less than 15 days before, or no-show: 100%.

4.2 Non-refundable services (for example, dated tickets or events) may incur a charge of 100% of their amount at any time. Services voluntarily not used during the journey do not give rise to any refund.

4.3 A change of dates or postponement of the journey is treated as a cancellation and this policy applies.

4.4 If the number of travellers is reduced before the date of the final payment, the deposit corresponding to the traveller who does not travel will be forfeited and the price per person for the others may be recalculated; allumette will inform the traveller of this before confirming the change. After that date, the full amount corresponding to that traveller must be paid.

4.5 The traveller may cancel without paying any penalty if unavoidable and extraordinary circumstances occur at or near the destination that significantly affect the performance of the journey.

4.6 The traveller may transfer the booking to another person who meets the applicable conditions, giving allumette at least 7 days' notice before the start of the journey. The transferor and the transferee will be jointly and severally liable for payment of the outstanding price and of any additional costs arising from the transfer.

4.7 allumette recommends taking out travel insurance with cancellation cover. The choice of insurance is the traveller's, and allumette is not liable if the insurer refuses a refund.

05. Changes requested by The Traveller

allumette offers flexibility to change a booked journey. Changes of dates, services or number of travellers may lead to a recalculation of the price. Any additional cost will be communicated to the traveller, and no charge will be made without the traveller's consent.

06. Changes and Cancellations by Allumette

6.1 If, before the journey, allumette is forced to significantly alter any of the main services, it will inform the traveller without delay. The traveller may accept the change, accept an alternative service, if available, or terminate the contract with a full refund of the amounts paid. If the alternative service is of lower quality or cost, the difference will be refunded.

6.2 allumette may cancel the journey, with a full refund of the amounts paid and without further compensation, when it is prevented from performing it by unavoidable and extraordinary circumstances and notifies the traveller without delay.

07. Passports, Visas, Health, and Insurance

7.1 Each traveller is responsible for carrying the documentation required for the journey. To enter the Schengen area, passports must be valid for at least three months after the planned date of departure and must issued within the last ten years; we recommend six months' validity.

7.2 Citizens of the United States and Canada do not need a visa for tourist stays of up to 90 days in Spain. The European Union plans to introduce the ETIAS electronic travel authorisation; if it is in force on the date of the journey, each traveller must obtain it before departure.

7.3 The traveller must provide their own details and those of their companions exactly as they appear on their passports. Any costs or penalties arising from incorrect details or from failure to meet documentation requirements are borne by the traveller.

08. Liability

allumette is responsible for the proper performance of the services included in the journey. It will not be liable for any lack of conformity attributable to the traveller, to a third party unconnected with the provision of the services where unforeseeable or unavoidable, or to unavoidable and extraordinary circumstances. Any compensation due will be subject to the limits set out in the applicable legislation and international conventions.

09. Complaints

The traveller must report any incident or lack of conformity without delay during the journey, so that allumette can resolve it at the destination: mr.allumette@hotmail.com · +34 636 161 006. Complaints after the journey must be submitted in writing and will be handled with the utmost diligence.

10.2 Purpose and legal basis. We process your data to prepare, contract and carry out your journey and to answer your enquiries, on the basis of the performance of the contract or of pre-contractual measures (art. 6.1.b of Regulation (EU) 2016/679, GDPR), and to comply with legal accounting and tax obligations (art. 6.1.c GDPR). 10.4 Retention. We will keep your data for the duration of the contractual relationship and, thereafter, for the limitation periods of the applicable legal obligations, after which it will be deleted.

10.5 Images. We will only take or use photographs or videos in which you appear for advertising or promotional purposes with your prior, express and written consent, which you may withdraw at any time without affecting your booking.

10.6 Your rights. You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent, by writing to mr.allumette@hotmail.com. If you consider that the processing does not comply with the regulations, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

10.7 This processing is governed by the GDPR and by Spanish Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights.

11. Governing Law and Jurisdiction

These conditions and any dispute arising from them are governed by Spanish law, in particular Book IV of the Consolidated Text of the General Law for the Protection of Consumers and Users (Royal Legislative Decree 1/2007), which transposes Directive (EU) 2015/2302. The parties submit to the Spanish courts and tribunals, without prejudice to the rights granted to the traveller by consumer protection legislation.
